OFFICIAL RULES OF THE CONTEST ON INSTAGRAM GIVEAWAY MISTERY BOX
ORGANIZED IN THE PERIOD 20.10– 31.10.2020
SECTION I - ORGANIZER OF THE CONTEST
1. The organizer of the Contest “Win a MISTERY BOX” (hereinafter referred to as “Contest”) is SC Steel Consult SRL, hereinafter referred to as Organizer, for the benefit of My K Romania, headquartered in Ilfov, Popesti-Leordeni, block 10, staircase B , 2nd floor, apartment 81, with CUI RO 33606012 (hereinafter referred to as My K RO), carrying out activities related to the implementation of the Contest, contacting the winners and handing out prizes, hereinafter referred to as “Organizer”.
2. The competition will be conducted in accordance with the provisions of this Regulation, hereinafter referred to as the "Regulation", which is binding on all entrants. to the Organizer.
3. The organizer reserves the right to amend the Rules during the Contest, having the obligation to officially announce the public, in the same way as the initial information. Such changes shall be made public at least 24 hours before the entry into force.
SECTION II - LEGAL BASIS
1. The competition is organized in accordance with the provisions of Government Ordinance no. 99/2000, regarding the marketing of products and services on the market, with subsequent amendments and completions, as well as with the applicable Romanian legislation.
SECTION III PLACE AND DURATION OF THE COMPETITION
1. The contest is organized and takes place online, on the Instagram page of the My K Romania Brand (https://www.instagram.com/mykromania/?hl=en)
2. The contest will start on 20.10.2020, at 13:00, and will last until 31.10.2020, at 23:59:59, hereinafter referred to as “Contest Period” or “Contest Period”. Any Participant who does not fall within this time frame will not be considered.
SECTION IV RIGHT TO PARTICIPATE
1. The Contest is open to the participation of all individuals, domiciled / residing in Romania, at least 18 years of age (completed by the date of the Contest), who comply with the terms and conditions of these Official Regulations (hereinafter referred to as "Participants").
2. Relatives up to the 4th grade, including those of the Organizer, nor employees of the collaborating companies cannot participate in this contest.
3. Participation in this competition implies full and express knowledge and acceptance of these Regulations.
SECTION V CONTEST RULES
1. The rules shall be made available to any applicant free of charge for the duration of the competition in any of the following ways:
a. Online, on the link published by the Organizer on the day of the start of the contest and in the Bio section of the Instagram page mentioned in section 2 above.
b. following a written request, sent to the Organizer on the contest page, mentioned in Section 2 above.
2. According to the free decision of the Organizer, the Contest may be publicized, for the purpose of informing the public, including through advertising materials and / or for information purposes. The information that such materials may contain will be interpreted and supplemented in accordance with the provisions of the Regulation.
3. The Organizer will not assume any responsibility regarding the knowledge or ignorance of the Regulation and its amendments by the Participants, as long as they have been made available to the Participants.
4. No entrant will be able to request the continuation of the Contest nor the repair of a potential damage caused by the regular suspension of the Contest.
5. Participation in the Contest implies full and express knowledge and acceptance of the Rules.
SECTION VI COMPETITION MECHANISM
1. The competition mechanism is:
a) tag 3 friends, having active accounts on Instagram;
b) follow the My K Romania Instagram page (https://www.instagram.com/mykromania/?hl=en);
c) like the post in which the contest is announced.
2. Entries which do not comply with the provisions of this Regulation shall be invalidated.
3. Without prejudice to the provisions of these Regulations, the Organizer reserves the right to verify the situation and, if irregularities are found, the registration will be invalidated.
4. The winners will be chosen by random draw and announced on 01.11.2020, in the Insta Story post on the page mentioned in section 2.
SECTION VII AWARDS
Within this Contest, a total of 5 prizes, in products, worth RON 250 each, is awarded by drawing lots. Total value of the prizes: 1250 RON.
2. No additional direct or indirect costs are charged to the Contest entrants, except for the normal expenses of the Contest (cost of mobile data consumed).
3. The winners have neither the possibility nor the right to request the modification of the characteristics of the prizes nor the granting of the cash value of the prizes. Winners are the sole recipients of the prizes awarded and may not assign rights to the prizes won to others.
4. Prizes awarded may not be replaced by other goods or services or their cash value. In the event of a potential Winner's refusal to receive the prize (by refusing a Winner to signify that the Winner does not wish to take possession of the prize), he / she will lose the prize. If after the end of the Contest there are no prizes left, the Organizer reserves the right not to award them.
5. The refusal to receive the prize must be expressly expressed within a maximum of 24 hours from the date on which the Organizer notified the Winner of the winning of the prize. If the potential Winner does not show any options within this period, the prize will be awarded to the reserve, if the conditions of validity by the winner of the reserve are met again.
6. If the winner of the prize is a person lacking the capacity to exercise (persons who do not have the capacity to exercise - not including the minority) he is entitled to take possession of the prize only through the legal guardian, including the signing by the curator of a statements, if any, according to the law, by which the Organizer is absolved of any liability arising from the award of that prize, as well as the payment of any damages or claims of any kind, related to the prize and the person's participation in the Contest.
SECTION VIII DRAWING AND DESIGNATION OF WINNERS
7. The draw will be electronic and will be carried out by the Organizer and registered.
8. All valid entries made during the Contest Period participate in the draw.
9. For each prize a winner and 3 reserves will be drawn. If a winner cannot be announced or validated within the time limits and under the conditions set out in Section 9 of the Rules below, the first reserve of that winner will be called, in the order of the draw, and the same procedure will be followed. announcement and validation. If the procedure for all 3 reservations is completed and the validation for the last reservation is not completed correctly, the respective prize will not be awarded, it will remain in the possession of the Organizer.
SECTION IX ANNOUNCEMENT AND VALIDATION OF WINNERS. AWARDS
1. Announcing the winners
1.1. The winners will be announced on 01.11.2020, according to section 6 above.
1.2. If the prizes of the Contest are subject to taxation, according to the tax regime applicable at the time of awarding the prize, then the winner (s) and the personal numerical code will be requested, only for the purpose of fulfilling the legal formalities imposed by the Fiscal Code. .
1.3. The booking validation procedure is the same as the winner validation procedure. If the reservations cannot be contacted and validated, the prize will no longer be awarded to the reserves and will remain the property of the Organizer.
1.4. If a winner cannot be announced or cannot be validated within the terms and conditions of this Regulation, the first reservation of that winner will be called, in the order of the draw, and the same announcement and validation procedure will be followed.
2. Awarding of prizes
2.1. The prizes will be sent by courier, to the residence address provided by the winner by private message to My K Romania, on the page mentioned in section 2, after announcing the winner on Insta Story and by a private message.
2.2. The entrant to the Contest, designated winner after the draw, who refuses or does not meet the conditions set out in the Rules automatically loses the status of winner and can not take possession of the prize.
2.3. Prizes that, based on the provisions of this Regulation, cannot be awarded, will remain at the disposal of the Organizer, who may dispose of them as he deems appropriate.
SECTION X RELATED TAXES AND TAXES
1. The Organizer of the Contest is not responsible for the payment of any other fees or other financial obligations related to the prize offered, which are the responsibility of the winner.
SECTION XI PROTECTION OF PERSONAL DATA
1. By entering the Contest, the Participants agree with the provisions of the Rules and agree that, if they win, the name, email address, telephone number and residence address will be provided to the Organizer, in order to deliver the prize, with their deletion by him after the delivery of the prize.
2. The organizer undertakes to comply with the provisions of Regulation (EU) no. 679/2016 (hereinafter “GDPR”), regarding the protection of the personal data of the Participants stored during the Contest and after it. As such, the Organizer undertakes to maintain the confidentiality of the personal data of the Contest Participants and to use them in accordance with the legislation in force.
3. Participants shall be guaranteed the rights provided by the GDPR with regard to the protection of individuals with regard to the processing of personal data and on the free movement of such data, and in particular with regard to:
a) the right of access to data according to which any data subject has the right to obtain from the Organizer, upon request and free of charge for one request per year, the confirmation that the data concerning him are or are not processed by the Organizer;
b) the right of opposition according to which the data subject has the right to oppose at any time, for justified and legitimate reasons related to his particular situation, that the data concerning him be processed, unless there are contrary legal provisions ;
c) the right to intervene on the data according to which any data subject has the right to obtain from the Organizer, upon request and free of charge:
i. where appropriate, rectification, updating, blocking or deletion of data the processing of which does not comply with the law, in particular incomplete or inaccurate data;
ii. where appropriate, the transformation into anonymous data of data the processing of which does not comply with the law;
SECTION XII DISPUTES
In case of any disputes between the Organizer and the contest participants, they will be settled amicably. If it is not possible to settle the dispute amicably, the parties to the dispute will refer the dispute to the competent courts.
