Placing orders on the site

By completing the order, the buyer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true at the time of placing the order. Availability of offers and products
The offers presented on the site are constantly subject to changes, so that the displayed products may or may not exist in stock, a refusal in this regard will be communicated later.

Methods of payment and delivery of orders
For the payment of the order, depending on the preferences or the options available for the respective order, a bank card (Visa, MasterCard, Maestro), payment order or cash on delivery is accepted.
Orders can be shipped by express courier or can be picked up from the seller's premises. The delivery time of the products by express courier, normally is between 2 days and 2 weeks, from the moment of registering the order on the website www.my-k.ro. Most of the time the courier will deliver the orders within 2-3 working days from their shipment. The seller agrees to send the tracking number (if any) for each order shipped by express courier to the shipment confirmation email.
For various reasons, deliveries made by the carrier may not be made within a maximum of 2-3 business days (adverse weather conditions, strikes, system errors, etc.), and in these situations please ask for details of your package in writing or by phone, the courier company, using the AWB tracking number found in the e-mail received from us, and if you are not satisfied with the transport services provided by the courier company please let us know the situation created to fix the problem .
The seller is not responsible for damages caused by delays in delivering orders due to external factors: adverse weather conditions, road accidents, strikes, calamities, street demonstrations or other special situations that could prevent the express courier from delivering packages within 2- 3 days (example of other situations: system errors of the carriers, high volume on the respective route, etc.). The seller will not pay compensation for damages caused by failure to deliver the products on time. The seller does not grant compensation for packages delivered late for reasons beyond the seller's competence. The customer can exercise his right of withdrawal and can refuse any package delivered late.
Although the Site is accessible worldwide, not all products discussed or sold on the Site will be available to all persons or in all jurisdictions or geographic locations. SC MY K RETAIL & DISTRIBUTION SRL offers and sells products only to Romanian residents and ships parcels only to addresses on the territory of Romania. Billing - payment
The prices of the displayed products and services are expressed in lei and include VAT according to the legislation in force. The price, payment method and payment term are specified in each order. The seller will issue an invoice to the buyer for the delivered products and services, the obligation of the buyer being to provide all the information necessary to issue the invoice in accordance with the legislation in force.
The seller will send the invoice to the buyer for the order as well as for any other payments related to the order, including electronic invoices, by adding the invoice to the customer's account or by e-mail, to the e-mail address mentioned by the customer in his account, as appropriate. . All packages are accompanied by the confirmation of the order on printed media.
All invoices for your orders are available for download on the Site, can be accessed from My Account - Invoices. Invoices and orders already delivered cannot be changed.
For the correct communication of the invoice related to the order, the customer has the obligation to update whenever necessary the data in his account and to access the information and documents related to each order, existing in my Account.
If the orders are paid with a card associated with an account in a currency other than RON, the transactions are made in lei, at the exchange rate of the issuing bank for that card. For payment by bank card the seller does not charge additional fees.
Cancellation of orders by the seller
The seller may cancel the order placed by the buyer, following a prior notification to the buyer, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other party in the following cases:
- non-acceptance by the issuing bank of the buyer's card, of the transaction, in case of online payment;
- invalidation of the transaction by the card processor approved by the seller, in case of online payment;
- the data provided by the customer on the Site are incomplete and / or incorrect;
Return policy of delivered products
Dissolution of the sales contract
The right to withdraw from a contract for the sale of products purchased at a distance, is regulated by Art. 9 - Art. 16 of the Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing normative acts (hereinafter referred to as “GEO34 / 2014”).
In accordance with the provisions of GEO34 / 2014, the Client is entitled to withdraw from a distance contract, without having to justify the decision to withdraw and without incurring other costs than those provided in art. 13 para. (3) and to art. 14 of OUG34 / 2014.
Without having to justify the decision to withdraw, the Customer has a period of 14 (fourteen) days to withdraw from the Contract, a period calculated from the day on which the Customer or a third party other than the Courier and which is indicated by in the delivery address of the order, enters the physical possession of the products (Art. 9 of GEO34 / 2014).
Exercise of the right of withdrawal
In order to exercise the right of withdrawal, the Customer, before the expiry of the withdrawal period (see the Withdrawal Term above), will inform SC MY K RETAIL & DISTRIBUTION SRL (My K Romania) of his decision to withdraw from the Contract, by by means of a request / declaration of withdrawal which must contain:
- name of the buyer, email address and order number
- name and number of pieces for the products to be returned
- the payment method used for the order
- date of delivery of the products
- for orders paid in cash or with the card in the store, it is necessary to mention the IBAN account where the value of the products can be refunded
- reason for return (optional)
SC MY K RETAIL & DISTRIBUTIONSRL will confirm to the Customer without delay, on a durable medium, for example by email, the confirmation of receipt of the withdrawal request within 2 working days.
Exemptions from the right of withdrawal
Exceptions to the right of withdrawal regarding distance contracts are contracts for the supply of products that have been unsealed or opened by the Customer. According to article 16, letter e of GEO34 / 2014, used / tested cosmetic or personal use products cannot be returned for health protection or hygiene reasons.
Obligations of the customer in case of withdrawal
In accordance with Art. 14 of GEO34/2014, the Customer, in the event of exercising the right of withdrawal, undertakes to return by shipment to the headquarters of SC MY K RETAIL & DISTRIBUTION SRL, without undue delay and within no more than 14 (fourteen) days from the date on which he communicated his decision to withdraw from the Contract.
The customer bears the costs of returning the products and undertakes to return the products only through courier companies or personally, informing SC MY K RETAIL & DISTRIBUTION SRL about the shipment of the return. The customer is only responsible for the diminution in value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and functioning of the products.
For partial order returns, if the value of the remaining products in the order does not comply with the conditions of the offer / promotion regarding free shipping, more precisely their cumulative value does not exceed 450 lei, we will refund the value of returned products less the cost of a transport related to stored products. are attached to an order that does not qualify for free shipping).
Returns due to differences / discrepancies in color / odor / texture between the same type of product from different batches / similar batch will not be accepted, as they do not represent a non-compliance / hidden defect.
Considering the nature of the products sold by SC MY K RETAIL & DISTRIBUTION SRL, the Customer undertakes to return the products in a perfect and flawless condition, unused/untested, with the original seal and packaging, respectively in a condition in which the Product can be sold again. The product will be returned with all accessories, free samples, gifts, in the original undamaged packaging and instructions for use.
The customer will return the Product to SC MY K RETAIL & DISTRIBUTION SRL at the address: Monaco Towers, Soseaua Berceni 96, tower A, et. 5 ap. 3, Sector 4, Bucharest. 0731 718 789. SC MY K RETAIL & DISTRIBUTION SRL does not accept parcels sent to an address other than the one mentioned above or parcels sent by Romanian Post.
In the situation where the products may be subject to the contractual right of withdrawal, after the quantitative and qualitative inspection of the returned products, SC MY K RETAIL & DISTRIBUTION SRL will confirm the assumption of the necessary legal obligations in the case of withdrawal.
Obligations of the seller in case of withdrawal
SC MY K RETAIL & DISTRIBUTION SRL will return all amounts received as payment from the Customer, including, as the case may be, delivery costs, no later than 14 days from the date on which SC MY K RETAIL & DISTRIBUTION SRL entered into physical possession of all products returned by the Customer. For the partial return of an order and for the return of open parcels, the delivery costs paid by the Customer when placing the order are not refunded.
SC MY K RETAIL & DISTRIBUTION SRL will reimburse the amounts due as follows:
- for orders paid by bank card, online - by refund to the account from which the payment was made;
- for orders paid by bank card in the store at the POS machine and for orders paid in cash - by bank transfer, it is necessary to provide us with the details of a bank account for the transfer of amounts;
- for orders paid by bank transfer (payment order) - by refund to the account from which the payment was made;
The refund of the amounts paid by the Customer to SC MY K RETAIL & DISTRIBUTION SRL cannot be made in cash.
Conditions for packages delivered with visible signs of damage
All products sold by My K Romania Romania are new and delivered in the original packaging of the manufacturer. The products are properly packaged for transport and are insured throughout transport until delivery. Findings regarding the integrity of visibly damaged packages will be made in the presence of the courier agent. Any subsequent complaint will not be considered.
The buyer or the recipient of the order is asked to check the apparent condition of the package at the time of delivery, to check the contents of the package and the integrity of the ordered products, immediately after receiving the package. In this way, any unpleasant situation caused by handling during transport or other factors can be remedied as soon as possible.
In case of a visible anomaly regarding the package (damaged package, open package, traces of liquid, etc.) or the ordered products (missing products, damaged products), the buyer or consignee of the order will have to follow the procedure described below accordingly. order conditions.
Failure to follow the proper procedure precludes the possibility of any claim against the carrier and My K Romania Romania, and the buyer will not be able to claim any refund of any amount and will not be able to claim that My K Romania will deliver the ordered products again.
Mandatory procedures when the package is damaged
Finding in the presence of the courier agent
My K Romania Romania does not offer the service of opening the package before its payment. It is not allowed for the buyer to condition the receipt of the package or the payment by cash on delivery of the order price by opening the package or checking its contents!
In case of visible damage to the package, the buyer will refuse delivery and will immediately, clearly and in detail formulate all reservations regarding the anomaly found. These reservations must be written by the recipient of the order on the delivery note of the courier company. At the same time, the buyer will report the objections to the Seller's Customer Service, at the telephone number 0731 718 789.
The seller will open a damage file for the damaged package and will provide a solution to remedy the problem (refund or replacement of products) within 7 days of receipt of the notification.
Finding in the absence of the courier agent
The buyer will report the damages or deficiencies found, formulating all the complaints and reservations to the Customer Service, at the telephone number 0731 718 789 or by email: [email protected]. Notification of incidents and reservations must be made as soon as possible, but no later than 3 (three) working days from the date of delivery. In the notification, the customer will include the name, the email address used to place the order and the order number.
SC MY K RETAIL & DISTRIBUTION SRL will provide an answer regarding registered complaints, within a maximum of 14 (fourteen) days.
