ORGANIZED DURING THE PERIOD 16.11- 17.11.2020 and 26.11- 27.11.2020

Campaign description:

The "Black Friday" campaign takes place between 16.11.- 17.11.2020 and 26.11.- 27.11.2020 and is organized by SC Steel Consult SRL (hereinafter referred to as "Organizer") with headquarters in Splaiul Unirii, No. 9, Bl 10, Sc. B, Ap. 81, Popesti-Leordeni, County: Ilfov, Nr.ord.Reg.Com./an: J23/2737/2014, CIF: RO 33606012, correspondence address: Soseaua Berceni, Nr. 96, Monaco Towers, Block A, Floor 19-20, Apartment 19.05-20.05, Bucharest 4, legally represented by Mr. Ovidiu Constantin Moisa, as Administrator.

At the time of entering the Campaign, you accept sole responsibility for deciding whether your participation is legal under any jurisdiction applicable to you. By entering the Campaign, you agree with these "Official Rules" and with the fact that the Organizer's decisions are final and binding regarding the Campaign.

1 – ELIGIBILITY

Any natural or legal person, resident in Romania, over the age of 18 (at the start of the campaign), with full exercise capacity, can participate in this campaign. Legal and natural persons can purchase a maximum of 6 products from each code. There is no limitation on the number of purchased codes.

2 – PERIOD AND LOCATION OF THE CAMPAIGN

The campaign takes place on www.my-k.ro.

Campaign period ("Campaign Period"):

  • The campaign takes place online between 16.11.2020 at 00:00 until 17.11.2020 at 23:59, respectively 26.11.2020 at 00:00 until 27.11.2020 at 23:59.

3 – THE RIGHT TO PARTICIPATE

Any natural and/or legal person, resident in Romania, over the age of 18, who purchases products participating in the promotion, during the period mentioned above, within the limit of available stock, can participate in this campaign. www.my-k.ro.

4 – INFORMATION REGARDING THE PRODUCTS INVOLVED IN THE CAMPAIGN

The products involved in the Campaign: all products participating in the campaign will be indicated on the website www.my-k.ro through banners and the page dedicated to the campaign and advertising materials. The ordered products will be delivered within 7-10 working days from the confirmation of the order. Offers are valid within the limit of available stock.

5 – GENERAL CONDITIONS

The organizer reserves the right, at its absolute discretion, to disqualify any person who falsifies the registration procedure or operation of the Campaign, who violates these Regulations, who acts in an unethical or disruptive manner or who is determined to act with the intention of to disturb, abuse, threaten or harass any person.

The use, in any way, of fraudulent registration methods in the Campaign, will attract the cancellation of all registrations through these methods, and the people who use these methods will be disqualified.

If, for any reason, this Campaign cannot be carried out as planned due to causes beyond the Organizer's control, fraud, technical problems, or any other causes that, in the Organizer's opinion, corrupt or affect the administration, security, correctness, integrity or development corresponding to the Campaign, the Organizer reserves the right to cancel, terminate, modify or suspend the Campaign. In the event that the Campaign ends due to force majeure, fraud or technical difficulties before the end of the Campaign Period, an official announcement will be made at the Campaign location.

6 – LIMITATION OF LIABILITY

In no case will the Organizer be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages, resulting from your participation in this Campaign.

Without limiting the above, the products and services offered by the Organizer, including this Campaign, are offered "as is", without additional guarantees, explicit or implicit, compared to those that the Organizer is obliged to grant according to the legislation in force .

7 – LEGISLATION AND DISPUTES

This Regulation is governed by Romanian legislation. If one of the clauses is declared void, the other clauses will not be affected and will continue to be valid and applicable in accordance with Romanian legislation. Any dispute arising from these Regulations will be resolved by the competent courts at the Organizer's headquarters.

8 – CAMPAIGN REGULATIONS

The rules for participating / running the Campaign are available, free of charge, to any applicant at the Campaign location/Campaign website.

9 – FORCE MAJEURE

Force majeure is any event that cannot be controlled, remedied or foreseen by the Organizer, including the Organizer's impossibility, for reasons beyond its control and the occurrence of which determines its inability to fulfill its obligations under these Regulations.

If the above situation occurs or there is another force majeure situation that prevents or delays the execution of the Regulation or the continuation of the Campaign, the Organizer will be exempted from the responsibility regarding the fulfillment of the obligations during the period in which the fulfillment of the obligations will be prevented or delayed according to the law.

10 – TERMINATION OF THE CAMPAIGN

This Campaign may cease in the event of a force majeure event or in the event of a change in the legislative framework so that the organization and development of the Campaign will require an increase in the budget allocated to this project.

11.- PROTECTION OF PERSONAL DATA

  1. Through these Official Regulations, the Organizer and the commercial companies involved in the organization of the Campaign undertake to comply with the provisions of the legislation on the protection of personal data, respectively, of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals individuals regarding the processing of personal data and regarding the free circulation of this data and the repeal of Directive 95/46/CE ("GDPR") applicable starting from 25.05.2018.
  2. The Organizer acts as an operator according to the GDPR regarding the processing of personal data of users who sign up for the Campaign, and the Agency as the authorized representative of the Operator. The processing of personal data collected and used in the context of the organization and development of the Campaign will be governed by the rules described in these Regulations.

The purposes of personal data processing

Personal data are processed for the following purposes (the specific legal basis of processing was added in brackets when the purpose of personal data processing is detailed) on the basis of obtaining consent in accordance with art. 6 (1) (a) of the GDPR or of legitimate interests in accordance with art. 6 (1) (f) of the GDPR):

  1. organizing and running the Campaign, offering and granting discounts to the participating products;
  2. the use of the buyer's personal data for promotional and advertising purposes in connection with the current offers within the campaign (consent of the persons concerned);
  3. the transmission of commercial communications for marketing purposes such as offers regarding the Organizer's products, invitations to participate in contests, advertising lotteries, questionnaires or surveys and other similar communications (consent of the persons concerned);
  4. automatic processing, including profiling; (consent of the persons concerned);
  5. payment of taxes and relevant contributions and reporting to the competent public authorities (legal obligation of the Organiser);
  6. in order to conclude and execute a contract that the person in question concluded with SC Steel Consult SRL for the purpose of participating in the Campaign, resolving complaints and requests from customers, including aspects related to orders, such as delivery, invoicing, product returns, resolving potential disputes submitted to the courts, debt recovery;
  7. solving any complaints related to the organization and development of the Campaign and granting the displayed discounts;
  8. the implementation of the provisions of the Regulation for defense in court and/or other judicial or administrative procedures, including the investigation of possible violations, the realization of various reports, analyzes and statistical studies regarding the organized marketing campaigns and their success (the legitimate interest of the Organizer or the Partner );
  9. Archiving activities, if required by law (legal obligation of the Organizer).

If the consent of the persons concerned constitutes the legal basis for the processing of personal data, the persons concerned have the right to withdraw this consent at any time. In case the winners withdraw their consent for the processing of personal data for promotional and advertising purposes, the Organizer will stop said processing without affecting other processing operations of personal data that are based on other legal grounds. Participants who refuse to communicate or withdraw their consent for the processing of personal data necessary for participation in the Campaign, will not be eligible to participate in this campaign.

Source and recipients of personal data

The organizer can disclose personal data to:

  • Its partners, acting either as operators or as authorized persons, to the public notaries/lawyers appointed to provide assistance for the organization and development of the Campaign.
  • Other companies in the Group.
  • Providers of services related to marketing activities (marketing agencies, companies providing e-mail marketing services).
  • Courier service providers, mobile telephony.
  • Suppliers of products participating in the Campaign.
  • Public authorities or other categories of recipients, including other companies in the Group, if the disclosure is based on an appropriate legal basis (such as a legal obligation, consent or legitimate interest).

Data retention period

Personal data are kept as long as necessary to fulfill the purposes for which they were collected, in compliance with the internal procedures regarding data retention, including the applicable archiving rules.

For example, the personal data collected for the purpose of the Campaign will be stored for its duration plus an additional period of at least 3 years (which is the statute of limitations for legal actions). With regard to the data of buyers for whom we have various reporting obligations and the payment of fees and taxes, they will be kept for the entire archiving period according to the financial and accounting rules.

The rights of data subjects

According to the law, the concerned personnel benefit from a series of rights. Starting with the entry into force of the GDPR, the data subjects benefit from the following rights:

  1. Right of access:the persons concerned have the right to obtain from the Operator confirmation that they are processing their personal data, as well as information regarding the specifics of the processing such as: the purpose, the categories of personal data processed, the recipients of the data, the period for which the data are kept, existing the right to rectification, deletion or restriction of processing. This right allows them to obtain a free copy of the processed personal data, as well as any additional copies for a fee;
  2. The right to rectify data:the persons concerned have the right to request the modification of their incorrect personal data or, as the case may be, the completion of incomplete data.
  3. The right to erasure:data subjects have the right to request the deletion of their personal data when:
  • They are no longer necessary for the purposes for which they were collected and are being processed;
  • They have withdrawn their consent for the processing of personal data and the Operator can no longer process them on other legal grounds;
  • Personal data are processed against the law;
  • Personal data must be deleted according to the relevant legislation;
  1. Withdrawal of consent and right of opposition: the persons concerned have the right to withdraw their consent at any time regarding the processing of personal data processed on the basis of consent. Also, they can object at any time to processing for marketing purposes, including profiling carried out for this purpose, as well as processing based on the legitimate interest of the Operator, for reasons related to their specific situation.
  2. Restriction: The data subjects have the right to request the restriction of data processing in the following situations:
  • In the case of disputing the correctness of personal data, for a period that allows the Operator to verify the accuracy of these data;
  • If the processing is illegal, and the concerned persons oppose the deletion of personal data, requesting instead the restriction of their use;
  • If the Operator no longer needs the personal data for the purpose of processing, but the concerned persons request them for a court action;
  • If the data subjects objected to the processing, for the period of time in which it is checked whether the legitimate rights of the Operator prevail over their rights as the data subject.
  1. The right to portability: To the extent that personal data is processed by automated means, the data subjects have the right to request the Operator to provide personal data in a structured, frequently used and automatically readable form. If the persons concerned request this, the Operator may transmit their personal data to another entity, if it is technically possible.

Before complying with any such request, we reserve the right to verify your identity, to ensure that the request comes from the person concerned.

The right to lodge a complaint with the supervisory authority and claim in court: data subjects have the right to lodge a complaint with the data processing supervisory authority if they consider that their rights have been violated: the National Authority for the Supervision of Data Processing with Personal Character; Address: General Gheorghe Magheru Boulevard no. 28-30, Sector 1, Bucharest; e-mail [email protected]. Also, the concerned persons have the right to go to court.

12 – THE LEGAL BASIS

This Regulation is in accordance with the provisions of the national legislation regarding the sale of products and services, respectively Government Ordinance no. 99/2000 and the legislation regarding the protection of natural persons in relation to the processing of personal data and the free movement of such data.

Complaints regarding the products or services involved in the Campaign after the completion of the Campaign in accordance with these Regulations will not be taken into account and will not represent the Organizer's responsibility.

In case of attempted or fraudulent use of the Campaign system, abuse or any facts that affect the Organizer's image, the Organizer reserves the right to take all necessary measures to remedy the situation.

The organizer will take all the necessary measures to run the Campaign under normal conditions according to the above, but does not assume responsibility for complaints, appeals of the participants that do not concern the violation of the legal framework in force.
